The adhesive mark has already begun to appear on the fenders and columns of Italian scooters. As of June 30, 133,135 had been released, with Milan and Rome alone close to half the national total. Now the last step of the new regulation is missing: from Thursday 16 July 2026, private electric scooters will only be able to circulate with civil liability coverage linked to the identification code of the vehicle.
The date was set by a joint circular from the Ministries of Business and Transport, after a sixty-day delay requested by the companies to complete the IT connections between the Motorization platform, the Ania database and the insurance systems. Helmets for all drivers have already been mandatory since December 2024, while the identification badge became fully operational in mid-May.
What the new insurance covers
The policy is used to pay for damages caused during the use of the scooter: injuries to pedestrians, cyclists or other road users, damage to cars, bicycles, shop windows and other property. The coverage follows the vehicle identified by the mark, according to a structure very similar to that already applied to cars, motorcycles and mopeds.
The minimum limits indicated by the Ministry of Business are equal to 6.45 million euros for damage to people and 1.3 million euros for damage to property. They are the same minimum thresholds established by the Insurance Code for other motor vehicles. Damage exceeding the maximum limit leaves the excess portion to be paid by the person responsible.
For at least the first two years the direct compensation procedure will remain suspended. Anyone who suffers an accident caused by a scooter will therefore have to contact the responsible company, following the ordinary procedure. In the meantime, Ivass will collect data on claims, costs and compensation to build the specific compensation system necessary to include scooters in the direct mechanism. July 2028 therefore represents the earliest possible deadline, subject to the results of the monitoring.
How much will the policy cost
The market is still taking shape and prices can change quite a lot depending on the company, the age of the driver, place of residence, deductibles and additional guarantees. The first estimates circulated in recent months placed the bonus between 50 and 100 euros per year. The most recent estimates released by consumer associations indicate a range of around 35-55 euros for basic coverage, with amounts that can reach around 150 euros by adding driver injuries, legal protection, assistance and waiver of compensation.
It is therefore worth looking beyond the large printed price. A cheap policy may have a high deductible, limit authorized drivers, or allow the company to recover what you paid if certain violations occur. Before signing, the parts dedicated to driving without a helmet, driving under the influence of alcohol, borrowing a vehicle and transporting a passenger should be read in particular.
The RC family remains outside
The classic breadwinner’s policy and the old “multimobility” covers linked to the person do not automatically satisfy the new obligation. The liability insurance requested from 16 July must include the sticker code and be registered in the insurance database connected to the Motorisation platform.
Many family policies also exclude vehicles that are legally required to be insured. The same goes for various products dedicated to micromobility which cover bicycles, hoverboards, scooters and sharing vehicles: they may continue to offer additional guarantees, however their simple existence does not replace the RCA referring to the single scooter.
The policy can also be registered in the name of a child aged 14 and over. For minors, the procedure is presented by a parent or person with parental responsibility. When the same scooter passes between parents, children or other family members, the contract must provide a driving formula capable of covering all users. A policy reserved for the owner only can open the way to compensation in the event of an accident caused by another person.
Passengers, compensation and sharing scooters
Only the driver can get on the scooter. The transport of a passenger, animals or objects remains prohibited. In the event of an accident, the injured third party retains the right to compensation; the company can then ask the owner or driver for total or partial refund of the sums paid, when the contract provides for compensation for that type of violation.
The same attention applies to the helmet, which is mandatory at any age. Some companies may offer a no-claims clause, often for an additional fee. Its presence reduces the risk of being presented with the bill after an already settled claim. Conditions, limits and any deductibles change from one contract to another.
Those who exclusively use shared scooters avoid taking out a personal policy. The coverage is managed by the rental company and becomes part of the cost of the service. The conditions set by the manager remain valid: irregular driving, use by excluded persons, passing of credentials or serious violations may lead to charges and refund requests.
The fine reaches up to 400 euros, automatic seizure does not
Anyone who is stopped from 16 July with a scooter without RCA risks an administrative fine of between 100 and 400 euros. The same band applies to circulation without a permit, with a hidden, altered or counterfeit permit. The police will be able to check the coverage by cross-referencing the identification code and the Ania database.
A clarification is needed regarding the seizure. The law does not provide for the automatic seizure of normal electric scooters without insurance. For a compliant vehicle, with continuous nominal power within the permitted limits, the financial penalty is triggered. The seizure aimed at confiscation concerns non-standard scooters equipped with a combustion engine or an electric motor with a power greater than 1 kW. The distinction matters, because these days the two consequences are often lumped together.
