From 14 December 2024, the Traffic Laws introduced new rules that significantly change the practice of lend a car to a third partyeven within the same family. In Italy, it is now necessary to formalize the vehicle loan to avoid heavy penalties. This change aims to improve road safety and ensure a more rigorous control on the use of vehicles.
According to the new provisions, a car can be driven by a person other than the owner alone for a maximum period of 30 consecutive days. This rule also applies to non-cohabiting family members, such as children who live elsewhere. Once this limit is exceeded, the driver risks significant administrative sanctions, which they range from €728 to €3,636in addition to the possible withdrawal of the registration document. These measures are designed to avoid unauthorized or uncontrolled use of vehicles.
Roadside checks have been intensified to ensure compliance with the regulations. The police, during checks or accidents, record the data of the vehicle and the driver. If the same person is stopped driving the same vehicle after 30 days, without formal authorization, the foreseen sanctions will be triggered.
The solution: the loan agreement
For those who need to regularly drive an unregistered car, a practical and legal solution has been provided: the loan contract. This is a formal agreement that authorizes the temporary driver to use the vehicle without time restrictions.
This contract must be registered with the Civil Motorization Office, requesting the filling out the TT2119 form and a statement signed by the car owner. The cost for registration, including tax and administrative fees, is approximately €26.
Registering the loan not only allows you to comply with the new rules, but protects both the owner and the driver. In case of accidents or infringements, the responsibilities are clearly attributedreducing the risk of disputes. Furthermore, insurance policies must be carefully checked to ensure that they are compatible with the new provisions and with the type of contract chosen.
