The Mondello beach returns to public administration after almost a century: last February 26 the Sicily Region revoked the concession to the Italian-Belgian company, which, in the meantime, announced its appeal to the TAR.
The dispute had started quite some time ago, but finally, with the DDG signed by the Director General of the Environment Department Calogero BeringhelitheRegional Department of Territory and Environment communicated that it considered the counterarguments presented by the company Mondello Immobiliare Italo Belga to be insufficient, thus adopting a provision for the revocation of the maritime state concession for serious violations and failure to fulfill the obligations deriving from the concession itself.
(…) are declared lapsed, pursuant to art. 47 of the Navigation Code, and in particular letter e) “for abusive substitution of others in the enjoyment of the concession” and letter f “for failure to fulfill the obligations deriving from the concession, or imposed by laws or regulations”, the CC.DD.MM n. 303/1991 and n. 73/2008 issued to the Mondello Immobiliare Italo Belga SA company

In particular, the company allegedly entrusted some services to GM edil without having requested prior authorization from the department. Furthermore, the assignment would have concerned the ordinary and extraordinary maintenance of sunbeds, umbrellas and chairs, as well as the ordinary and extraordinary maintenance of the wooden cabins, all activities covered by the concession.
The company, as expected, did not silently accept the revocation, and announced an appeal to the TAR.
