Citizenship, layoffs and contracts: here are the 5 questions of the June referendum

On 8 and 9 June 2025 we will vote at Ben Five abrogative referendums: 4 at work and one on citizenship. In this case, therefore, voting “yes” will mean wanting to cancel the rule indicated in the question. To ensure that the consultation is valid, it will be necessary to reach the quorum at least half of the entitled to vote.

The referendums, organized with decrees of the President of the Republic 25 March 2025 (Official Gazette, General Series, n.75 of March 31, 2025), are:

1. I illegitimate layoffs: reinstatement or compensation?

The repeal of Legislative Decree 23/2015, the “Jobs Act” is proposed, which introduced the contract to growing protections. Currently, in companies with more than 15 employees, those hired after March 7, 2015 are not entitled to reinstatement in the event of unjustified dismissal, but only to economic compensation. If the referendum was approved, we would return to a system that allows, in the event of a favorable sentence, the return to work for those who have been fired without just cause. ​

The second question concerns the workers of small businesses, those with less than 16 employees. Currently, even in the case of dismissal deemed illegitimate by a judge, the maximum compensation provided is 6 months (up to 14 in some specific cases). With this referendum, you want to make sure that it is the judge, on a case -by -case basis, to choose what the right compensation is. In this way, more protections are given to those who work in small realities. ​

The third question proposes the partial repeal of some rules of Legislative Decree 81/2015 concerning fixed -term contracts. Currently, it is possible to enter into fixed -term contracts without having to justify the reason for a whole year. With the approval of the question, we would return to the obligation to indicate a specific causal already from the first contract. The goal is to limit the abuse of fixed -term contracts and encourage more stable hiring forms, to the advantage of especially young people e neo -eighteenth in the world of work. ​

4. Work safety: responsibility in case of accidents

The fourth question concerns responsibility for accidents at work. Currently, in case of accident at work, the client (i.e. those who entrust the work) can be held responsible together with the contractor or subcontractor. The referendum proposes the repeal of this solidarity liability, limiting it to the damages deriving from specific risks proper to the activity of contracting or subcontracting companies. The goal is to clarify the responsibilities in the event of accidents at work, avoiding that the client is held responsible in all cases. ​

5. Italian citizenship: times of residence

The fifth question proposes to reduce From 10 to 5 years the period of legal residence in Italy necessary to request Italian citizenship. Currently, a foreigner must legally reside in Italy for at least 10 years to be able to apply for citizenship. With the approval of the referendum, this period would be halved to 5 years, facilitating access to citizenship for foreigners who live and work in Italy. ​

How to vote

The referendums will be held on Sunday 8 June and Monday 9 June. Voters can express themselves with a “yes” or a “no” on each question. For citizens temporarily abroad or out of office, it is possible to request the vote by correspondence by May 4, 2025.
