A fundamental turning point for Italian schools and for the future of the young generations. The Central Office for the referendum at the Court of Cassation has given the official green light to the referendum request promoted by the organizing committee to repeal the controversial law of 9 June 2026, n. 104.
The law, strongly supported by the Minister of Education and Merit Giuseppe Valditara, introduces the obligation of prior and written informed consent from parents for student participation in extracurricular activities on affectivity and sexuality. After an impressive mobilization which saw the collection of over 576,000 signatures across the country, the promoters are celebrating the overcoming of the first bureaucratic obstacle, ready to transform this victory into a real civility campaign at national level.

The role of the Council and the rules of the law on informed consent
The path towards the opening of the polls now includes a decisive step: the admissibility judgment entrusted to the Constitutional Court. The Consulta will be called to verify whether the question respects the limits established by Article 75 of the Constitution in terms of clarity and coherence of the abrogation. Currently, law 104, which came into force on 7 July 2026, requires schools to request written authorization from parents at least 7 days before carrying out projects dedicated to affectivity.
The legislation excludes these paths for nursery and primary schools, however leaving traditional curricular science lessons and programs dedicated to combating violence and discrimination outside the scope of consensus. The National Association of Principals has also highlighted the organizational difficulties arising from the need to manage alternative activities for those who do not join, in the absence of additional financial resources.

The effects of the vote and the race towards a quorum in spring 2027
The victory of the possible referendum would not automatically introduce new compulsory sexual education teaching in classrooms, but would eliminate the special constraints introduced by the new law, restoring full autonomy to the institutes and their three-year training offer plans. The objective expressed by the promoting committee is to have the electoral consultation carried out in spring 2027, coinciding with the first round of the local elections.
To achieve the definitive repeal of the law, it will still be necessary to pass the double quorum test: the participation of the majority of those entitled to vote and the prevalence of yes. The youth mobilization thus continues with meetings in the territories and memberships open until October 31st at this link, to bring the discussion on emotional well-being directly to the center of the political agenda.
