Last October 21st a historic complaint was filed for “ecocide” in Chile, concerning the serious pollution of Lake Villarrica and its surrounding areas. The initiative, promoted by Villarrica councilor Raúl Landini and lawyer Daniela Riffo, aims to create a legal precedent in environmental protectionrequiring criminal liability for the damage suffered by the lake as a result of the continuous discharge of sewage and other pollutants.
Lake Villarrica is known for episodes of algae bloomwhich represent a consequence of excessive pollution, a situation that puts at risk not only the local ecosystem, but also public health and the tourism economy of the region. The pollution of the lake has reached alarming levels, with the presence of fecal coliforms and the Helicobacter pylori bacteriumthe latter linked to the increase in gastric diseases, such as cancer, among the population.
The 2023 law allows anyone who causes damage to the ecosystem to be criminally prosecuted
Raúl Landini stated that this legal action is an attempt to draw the institutions’ attention to an environmental crime that it has worsened over the years. The councilor stressed that pollution not only undermines people’s right to live in a healthy environment, but endangers the health and well-being of local communities. He also expressed the urgency for action before the lake suffers irreversible damage.
Lawyer Daniela Riffo highlighted the fundamental role of the recent Chilean law 21.595 on economic crimes, which also includes attacks against the environment. This legislation, enacted in 2023, offers new legal tools for criminally prosecute anyone who causes damage to the ecosystemmaking it possible to protect the country’s lakes, rivers and wetlands. The complaint for ecocide represents an important milestone, as it allows these environmental crimes to be investigated with greater effectiveness and severity.
Organizations such as the Foundation for Sustainable Wetlands, through its director Sebastián Arredondo, have reiterated the need for a rapid and coordinated response. Arredondo appealed to the community and local authorities to become aware of the critical situation of the lake, highlighting the repercussions on public health and the economy. The hope is that this legal action can represent a turning point for environmental justice in Chile.
